OVERVIEW
Welcome to InstantLift+ (“InstantLift+,” “we,” “us,” “our”). We operate this website and online store, along with all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service (the “Terms”) together with any policies referenced here (e.g., Privacy Policy and Refund Policy) govern your use of the Services. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Access and Account
You represent that you are at least the age of majority in your state/territory of residence and you authorize any minor dependents using devices you own/manage to use the Services. You may be asked to provide information (email, billing, payment, shipping). You warrant such information is accurate and complete and that you have the right to provide it. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not sell, assign, or transfer your account.
2. Our Products (Cosmetics)
We strive to display products accurately; however, colors/appearance can vary by device. Cosmetic use only. Products are not intended to diagnose, treat, cure, or prevent any disease. Statements have not been evaluated by the FDA. Perform a patch test before first use and discontinue if irritation occurs. Usage not in accordance with directions is at your own risk. We may change descriptions, pricing, or discontinue products at any time and may limit quantities per person/household or region.
3. Orders
Your order is an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted when we confirm and process payment. Please review carefully before submitting; we may be unable to cancel once accepted. If we decline or change an order, we’ll attempt to notify you via the contact details provided.
Purchases are subject to our Refund Policy. You warrant purchases are for personal/household use and not for resale or export.
4. Prices and Billing
Prices, discounts, and promotions may change without notice. Prices at checkout apply at the time of order and are shown in USD unless stated otherwise. Unless expressly stated, prices exclude taxes, shipping/handling, and customs/import charges.
You agree to provide current, complete, and accurate purchase and payment information and to promptly update it. You represent that you’re authorized to use the provided payment method and agree to pay all charges, including applicable taxes and shipping.
5. Shipping & Delivery
Free Shipping Threshold: Orders $35+ ship FREE (Tracked); orders under $35 ship via Standard Shipping for $4.90 (subject to change).
Processing & Transit: Processing times and carrier transit times are estimates only and not guaranteed. Delivery may be affected by carrier delays, customs, weather, or events outside our control.
Risk of Loss/Title: Upon our transfer to the carrier, title and risk of loss pass to you. Please ensure your shipping address is accurate.

6. Intellectual Property
All content in the Services (trademarks, text, images, videos, graphics, design, selection and arrangement) is owned by InstantLift+, its affiliates or licensors, and protected by U.S. and international IP laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly stated. InstantLift+ names/logos are our trademarks. Shopify marks belong to Shopify. Other trademarks are the property of their owners.
7. Optional Tools
We may provide access to third-party tools “as is” and “as available,” without warranties and without liability. Your use is at your own risk and subject to the third party’s terms. New features/resources are part of the Services and subject to these Terms.
8. Third-Party Links
The Services may link to third-party sites or include third-party materials. We do not control and are not responsible for such content. Review the third party’s policies before engaging in any transaction. Any issues with third-party products/services must be directed to that third party.
9. Relationship with Shopify
InstantLift+ is powered by Shopify, but your purchases are with InstantLift+. Shopify is not a party to your transactions and is not liable for issues arising from them. You expressly release Shopify and its affiliates from claims arising from your purchases with InstantLift+.
10. Privacy
Personal information collected through the Services is governed by our Privacy Policy [LINK] and may also be processed by Shopify under Shopify’s Privacy Policy. Because the Services are hosted by Shopify, information you submit may be transferred to, processed, and stored in other countries to provide/improve the Services. For California residents, see “Do Not Sell or Share My Personal Information” (CCPA/CPRA).
11. Feedback & Reviews
If you submit any ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent you own the Feedback or have rights to grant this license and that your Feedback complies with law and these Terms. We may monitor, edit, or remove Feedback in our discretion.
12. Errors, Inaccuracies, Omissions
Information on the Services may contain errors or omissions, including in product descriptions, pricing, promotions, shipping charges, transit times, and availability. We may correct or update information or cancel orders if information is inaccurate, at any time without prior notice (including after an order is submitted).
13. Prohibited Uses
You may use the Services only for lawful purposes. You agree not to misuse the Services (e.g., violate laws, infringe IP, harass/abuse, transmit malware/spam, scrape, attempt unauthorized access, impersonate others, or interfere with security). We may suspend or terminate access for violations.
14. Termination
We may terminate or suspend access to the Services at any time, in our discretion, without notice. You remain liable for all amounts due through the termination date. Sections that by nature survive termination shall continue to apply.
15. Disclaimer of Warranties
Except as expressly stated by InstantLift+, the Services and all products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; those limitations may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL INSTANTLIFT+, OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, OR LICENSORS (OR SHOPIFY AND ITS AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS/REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.
17. Indemnification
You agree to indemnify, defend, and hold harmless InstantLift+, Shopify, and our affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or your use of the Services. We may control the defense and settlement; you will cooperate.
18. Severability
If any provision is determined unlawful or unenforceable, it shall be enforced to the maximum extent permissible and the remainder will remain in full force and effect.
19. Waiver; Entire Agreement
Our failure to enforce any right is not a waiver. These Terms, together with policies posted on the site (including Privacy and Refund Policies), constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
20. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.
21. Governing Law; Venue
These Terms and any disputes will be governed by the laws of the State of WY, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in WY.

23. Changes to Terms
You can review the most current version of the Terms at any time on this page. We may update these Terms by posting changes on the site and, where required by law, providing notice. Your continued use after changes become effective constitutes acceptance.
